Terms of Service
By using ButterySpace you agree to these. Written to be readable, numbered so you can find things.
01The service
ButterySpace is a web-based toolkit for makers, operated by DialUpDuo LLC, a limited liability company registered in Arizona, USA. It turns images into 3D bookmarks, rounds the edges of STL models, traces images into clean SVGs, makes coloring reliefs and lithophanes, converts photo formats, and repairs SVGs for cutters and lasers. No purchase, license, or account is required to use the core tools. By accessing butteryspace.com or any of its subdomains, you agree to these terms.
You must be at least 13 years old to use the service (or at least 16 where EEA consent rules apply, unless a parent or guardian agrees to these terms on your behalf).
02Acceptable use
You agree not to:
- Upload images that contain illegal content, or that infringe a third party's intellectual property rights.
- Upload images of identifiable people without their permission.
- Upload files designed to damage or probe the service, such as malware, decompression bombs, or exploit payloads.
- Automate requests to the service, scrape it, or otherwise bypass or circumvent rate limits or other anti-abuse measures without written permission.
- Use the service to facilitate anything illegal, hateful, fraudulent, or designed to harm others.
- Attempt to reverse-engineer, decompile, or interfere with the service's backend infrastructure.
We reserve the right to rate-limit or block access for any session that appears to be abusing the service.
03Your images and content
You retain full ownership of any images you upload. By uploading, you grant us a limited, non-exclusive, royalty-free license to process your image for the sole purpose of delivering the conversion result back to you. By default, processed files are held on Cloudflare R2 for up to 24 hours and then automatically deleted.
We do not sell your images or share them with third parties.
You are solely responsible for making sure you have the rights to whatever you upload. If someone brings a claim against us because of your content, Section 12 (Indemnification) applies.
Optional product improvement program. If you opt in via the cookie preferences panel, you grant us an additional license to retain your uploaded file (image or STL model) and the resulting output (SVG, STL, 3MF, or converted image) for up to 30 days, used solely to benchmark and improve ButterySpace's conversion and repair algorithms. We do not use opted-in data to train third-party AI models or share it externally. You may withdraw consent at any time by reopening the preferences panel (via "Cookie settings" in the footer), and you may request deletion of retained data via the Privacy page. Opting in or out has no effect on the conversion results you receive.
04Outputs and fabrication
The service generates outputs (SVGs, STL meshes, converted images) automatically from whatever you feed it. The outputs are yours, and so is responsibility for what you make with them:
- Check geometry, dimensions, and printability before fabricating. Automated conversion can produce thin walls, sharp points, or features your machine can't handle.
- Objects you print, cut, or engrave from our outputs are your products, not ours. They are not certified or tested as safety equipment, medical devices, food-contact items, or toys, and small printed parts can be choking hazards.
- Lithophanes work by passing light through thin plastic. Follow your lamp or LED hardware's heat guidance, and never leave a hot light source pressed against printed plastic unattended.
- Cutting machines move real blades and lasers. Verify paths in your machine's own software before you cut.
05Our intellectual property
The service, the ButterySpace name and brand, the site, and the conversion engine behind it belong to us and are protected by intellectual property law. These terms give you no license to the engine, its algorithms, or our trademarks. If you send us feedback or suggestions, we may use them without obligation or payment to you.
06Copyright complaints (DMCA)
We respect copyright and expect the same from users. Because uploads are discarded after processing and results auto-delete within 24 hours (30 days at most for opted-in sessions), allegedly infringing files usually remove themselves quickly, but we still act on valid notices within that window.
To send a takedown notice under the US Digital Millennium Copyright Act, email [email protected] with the subject "DMCA notice" and include:
- Identification of the copyrighted work you say is infringed.
- Identification of the material you believe infringes, with enough detail for us to find it (a URL, file name, or approximate upload time helps).
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
- Your physical or electronic signature.
If material you uploaded was removed because of a notice and you believe that was a mistake, you may send a counter-notice with the elements required by 17 U.S.C. § 512(g) to the same address. We terminate access for repeat infringers.
07Service availability
ButterySpace is offered "as is" and "as available". We do our best to keep the service running, but we make no guarantees about uptime, speed, or availability. The service is free to start and we reserve the right to change, suspend, or discontinue any part of it at any time.
08Future paid features
We plan to offer a paid Pro subscription and a developer API in the future. Joining the waitlist does not create a contract or guarantee any particular price or feature set. When paid features launch, their specific terms and our Refund Policy will be disclosed at purchase.
09Third-party services
The site uses Google Analytics, Cloudflare, and Resend (transactional email) as described in our Privacy Policy. Display advertising is not running today; if we introduce it, it may use networks such as Google AdSense or Sovrn, also described there. Some guides contain affiliate links: as an Amazon Associates participant we earn from qualifying purchases, and pages with affiliate links disclose them. Your use of ButterySpace is also subject to those providers' terms of service.
10Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any output will meet your needs or be suitable for fabrication. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
11Limitation of liability
To the maximum extent permitted by applicable law, DialUpDuo LLC is not liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of the service, nor for damage arising from objects you fabricate from outputs. Our total aggregate liability for all claims is capped at the greater of one hundred US dollars (US $100) or the amounts you paid us in the 12 months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot lawfully be limited, and nothing takes away statutory rights that consumers in the EU, the UK, or elsewhere cannot waive.
12Indemnification
You will defend, indemnify, and hold harmless DialUpDuo LLC and its members, officers, and agents from claims, damages, and reasonable legal costs arising from your content, your use of outputs, or your breach of these terms.
13Dispute resolution and arbitration
Talk to us first. Before filing any claim, email [email protected] with the subject "Dispute", describe the problem, and give us 30 days to resolve it. Most things get fixed here.
Small claims always work. Either side may bring an individual claim in small claims court instead of arbitration.
Arbitration. Any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration takes place in Arizona, in your home state, or by video, whichever you prefer. For claims where your filing cost would exceed the cost of filing in small claims court, we pay the difference in administrative and arbitrator fees.
One at a time. Disputes are resolved individually. Neither side may bring or join a class, collective, or representative action, and both sides waive any right to a jury trial.
Opt-out. You can opt out of this arbitration section, keeping the rest of these terms, by emailing [email protected] with the subject "Arbitration opt-out" within 30 days of your first use of the service after this section took effect.
Consumers in the EU and UK. This section applies to you only where your law permits. You keep the right to bring claims in your local courts and under your local consumer protection law.
14Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles. Subject to Section 13, any disputes arising from these terms or your use of the service will be resolved in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts. If you are a consumer in the EU or the UK, you also keep the benefit of any mandatory protections of the law of the country where you live.
15Termination
You may stop using ButterySpace at any time. We may restrict or block access for sessions that violate Section 02 (Acceptable use), without prior notice. Sections 03 through 06 and 10 through 16 survive termination.
16General terms
- Severability. If part of these terms is found unenforceable, the rest stays in force.
- Entire agreement. These terms, together with the Privacy Policy and Refund Policy, are the whole agreement between you and us about the service.
- No waiver. If we don't enforce a term, that is not a waiver of it.
- Assignment. We may assign these terms as part of a merger, acquisition, or sale of assets. You may not assign them.
- Force majeure. Neither side is liable for delay or failure caused by events beyond reasonable control.
- Export and sanctions. You agree not to use the service in violation of US export control or sanctions laws.
17Changes to these terms
We'll post material changes on this page at least 14 days before they take effect and update the "Last updated" date at the top. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
